Domain Service Terms and Conditions

Basic provisions

  1. These WEDOS Domain Services Terms and Conditions (hereinafter referred to as "DS Terms and Conditions") are part of the "General Terms and Conditions of Services of WEDOS, Internet a.s." ("GTC").
  2. The application of these Terms and Conditions shall take precedence over the application of the GTC.
  3. These DS Terms and Conditions govern registrations, re-registrations, renewals and changes to domain names held by the Operator and the WHOIS Domain Privacy Protection service.
  4. A registry is an organisation that is responsible for the management and operation of the relevant Top Level Domain (TLD). The term Registry also includes the so-called Registry Backend.
  5. If the Customer registers and manages domains in the name of a third party (domain holder), the Customer must ensure that the third party has agreed to these DS Terms and Conditions and the terms and conditions of the relevant domain registry, if any. Upon request, the Customer shall provide such consent, otherwise the domain name may be revoked without refund.
  6. The domain holder agrees that his/her personal data must be passed on to others if required for the management of the domain concerned and that his/her personal data must be published in the relevant registry information systems (WHOIS systems).
  7. The domain name is leased by the customer from the relevant registry, which is paid a fee for the lease of the domain. The operator is the technical administrator of the domain, not the owner or payer of the domain.
  8. Both the Customer and the domain holder agree to the rules of the relevant registry and the rules of the relevant TLD.
  9. The Customer is obliged to ensure that the correct and up-to-date details of the domain holder and other contacts and other information as required by the relevant registry are provided. Otherwise, the Customer runs the risk that the domain will be cancelled due to incorrect data without any compensation for funds or damages.
  10. The Operator is entitled to communicate directly with the domain holder if necessary.
  11. In the event of a request from the domain holder, the Operator may remove the domain from the Customer's account and place it under the direct management of the domain holder. In such case, the Customer is not entitled to a refund of any fees for the unused period of the domain.
  12. The operator offers various additional services for domains. An overview of these additional services is always listed in the current domain name price list or related documents. The Operator is entitled to change the price of additional services at any time with immediate effect. 
  13. The Operator is entitled to change the price for registration or renewal or re-registration or other similar operations with domain names from the next subscription period, i.e. from the moment of the next renewal of the service. 

Domain registration

  1. The ordered domain will be handed over for registration only after payment of the relevant fees according to the current price list and fulfillment of any other conditions required by the Operator or the relevant registry for the given TLD.
  2. Ordering or paying for a registration order does not entitle the Customer to the domain name. It only arises after the actual execution of the registration and its confirmation by the Operator.
  3. The Customer understands that the Operator may require the domain holder to provide additional documents or other requirements necessary to register the domain, according to the terms and conditions set by the relevant registry for the specific TLD. This may include personal data (birth number, ID number, date of birth), delivery of an officially certified document, sending a copy of a personal document, execution of consent to other conditions, etc.
  4. Domain registration will be carried out only if:
    - the relevant registry allows the registration of the domain name
    - the domain name is freely available for registration at the time of domain registration, the name is not blocked, reserved or prohibited in any way
    - the applicant for domain registration has fulfilled all the conditions set by the relevant registry
    - the relevant registry is fully functional and successfully confirms the domain registration
  5. The domain name that the Customer requests to register cannot be reserved or blocked in any way by completing an order. If another person interested in registering the same domain name fulfils all the requirements for registration earlier, the domain cannot be registered for the Customer.
  6. The Operator is not liable for any damages caused by the inability to register the domain.
  7. If the conditions for domain registration are not met, the order is cancelled after 30 days and the customer is refunded any fees already paid, if the order status allows it.
  8. The Operator does not check or verify the legitimacy of the Customer's request for registration of the domain name and is not legally responsible for it. The Customer is responsible for any problems or damages caused by trademark conflicts, court decisions or other obstacles that prevent the Customer from using the domain name.
  9. Similarly, the Operator does not check whether all non-technical requirements for domain name registration are met, in particular compliance with the various rules (e.g. other individual registry rules for a given TLD). In case of non-compliance, the domain name may be cancelled without refund. 

Domain Expiration and Renewal

  1. The Customer is obliged to pay the fees on time and fulfill other requirements for the domain renewal for the next period.
  2. If the Customer fails to comply with all requirements (in particular payment of fees for the next period and agreement of the rules) for the renewal of the domain more than 14 days before its expiration, the Customer and the domain holder risk cancellation of the domain. The Customer also acknowledges that in the event of non-renewal of a domain, the original content may not be available after expiry for some TLDs. 
  3. The customer is obliged to monitor and keep track of the expiration dates of their domains. The Operator shall inform the Customer of the impending expiry date, but is not obliged to do so. The Operator shall not be liable for any damages caused by the fact that the domain expiration notice was not delivered to the Customer.
  4. The domain will be extended for another period only if:
    - the customer has fulfilled all the requirements for domain renewal well in advance of its expiry
    - the relevant registry allows the domain renewal
    - the relevant registry is fully operational and successfully confirms the domain renewal
    - the domain has not been cancelled due to failure to renew on time
  5. In the event that the Customer does not respond to a domain expiration notice, the Operator is entitled, but not obliged, to inform the domain holder directly.

Domain re-registration

  1. The ordered domain re-registration will be performed only if the Customer and the domain holder fulfill all the requirements required by the Operator or the relevant registry for the given TLD. For some TLDs, the re-registration requires payment of an administration fee, a fee for the operation of the domain for the next period, entering authorization information or approval of the transfer in another way.
  2. Domain re-registration will only be carried out if:
    - the relevant registry allows the re-registration of the domain name, the domain re-registration or changes to the domain are not restricted or blocked in any way
    - the domain registrant has met all the conditions set by the relevant registry
    - the relevant registry is fully operational and successfully confirms the domain re-registration
  3. The Operator is not liable for any damages caused by the impossibility of re-registering the domain.
  4. If the conditions for re-registering the domain are not met, the order is cancelled after 30 days and the customer is refunded any fees already paid, if the order status allows it.

Domain changes

  1. All changes to the domain must be correctly authorized by the Customer, i.e. the Customer must prove the relevant login details. 
  2. The operator may require additional authorisation (e.g. by email, SMS or documentation) for some changes.
  3. Any changes to domains may be charged by the Operator according to the current price list or by agreement between the Customer and the Operator.
  4. The process of change for a domain will be initiated only after payment of any applicable fee and after all other requirements set by the Operator or registry for the TLD have been met.
  5. Changes to a domain can only be made if the state of the domain allows it and the registry allows such a change.

Cancellation requests for a domain

  1. A cancellation request is a request by the Customer or domain holder to cancel or suspend a pending registration, re-registration, renewal or other change to a domain.
  2. Where the situation allows, such a process may be stopped. The Customer's cancellation request may be charged by the Operator according to the current price list.
  3. In the event that the action can no longer be returned, the Customer cannot claim a refund of the fees associated with the request.
  4. It is not possible to cancel changes to domains if they have already been made. In this case, the Customer is obliged to request a change to the original data or status and to pay again any fees associated with such change.
  5. The process of domain registration or domain renewal does not allow for the refund of fees for already registered domains and the customer understands and agrees that the registration of a domain or its renewal is not subject to the statutory conditions for withdrawal from a distance contract (a contract with a consumer concluded by distance means according to the relevant legislation. Therefore, the customer cannot withdraw from the domain registration contract if the domain registration was made before the expiry of the consumer withdrawal period under specific legislation.

Operation and use of the domain

  1. The customer is fully responsible for how his domain is used and what web pages and other services are operated on it.
  2. In the event of a court (or other similar) dispute over the domain, the Operator may, by court order or decision (of a similar nature), prevent the Customer from using the domain or making the ordered changes. In the event of an ordered change of holder to someone else, the Customer shall not be entitled to a refund of any fees for unused domain term. Similarly, the Customer is not entitled to compensation for any damages caused by the restriction of use of the domain or ordered changes to the domain.

DNS

  1. The customer is responsible for the correct setting of DNS records on the authoritative DNS servers for the domain.
  2. The Operator offers free of charge the placement of DNS records of domains on its DNS servers for domains that are registered with the Operator (as a registrar) and at the same time these domains use other services offered by the Operator (for example, web hosting or virtual or dedicated servers).
  3. The Operator is not liable for any problems caused by the failure or unavailability of the Operator's DNS system.
  4. The Operator is entitled to delete a domain from the DNS system if the domain has not used the Operator's DNS servers for 60 days.
  5. The Operator offers the use of DNSSEC technology only for domains for which it is the registrar, and only in the following 2 variants:
    - the domain uses the Operator's DNS servers, records are signed with the Operator's DNSSEC keys, the Customer cannot use its own key
    - the domain does not use the Operator's DNS servers, the Customer must use its own DNSSEC keys
  6. The Operator is not responsible for any problems caused by incorrect settings or technical failure of DNSSEC technology.

WHOIS Domain Privacy Protection

  1. The Customer is entitled to subscribe to the WHOIS Domain Privacy Protection service for their domain name, which allows the Customer's registration details to be hidden from the public. The extent to which individual data is hidden varies according to the options offered and the service option chosen. 
  2. The WHOIS Domain Privacy Protection service is charged according to the current price list. The offered options are described in the current form on the Operator's website.
  3. The operator is not liable for any problems caused by the concealment of data to third parties.
  4. The operator offers this service only for certain domain extensions (TLDs) in accordance with the rules of the relevant domain registry. In the event that the rules of the domain registry are modified so that the WHOIS Domain Privacy Protection service cannot be used, the customer will be immediately informed of this fact, including the procedure (plan) for cancelling the service. In this case, the customer will be refunded the amount for the unused period (rounding the prorated amount to whole months).
  5. WHOIS Domain Privacy Protection is offered as an additional service to domain names and can be activated at any time. Activation of this additional service is possible immediately in the course of ordering a new domain name or re-registering an existing domain name with the Operator or with an existing domain name that is registered with the Operator (and where the Operator is the registrar). 

Customer support

  1. Customer support for domains is provided only through the community forum or in urgent cases by communication via tickets from the Customer Administration, on weekdays between 8:00 and 16:00 CET (GMT +1). Outside of these hours, we cannot guarantee proper domain renewal or resolution of administrative or technical issues with the domain, even those that may or do directly affect the functionality of the domain.
  2. It is possible to add other types of support to the domains according to the current offer provided by the Operator. 

Duration and termination of the agreement

  1. The contract is concluded for a fixed term, for a minimum of 1 year and a maximum of 10 years. The specific duration of the Contract is determined by written agreement between the parties or automatically by the Customer's choice of the length of the billing period when ordering the service, in which case the duration of the Contract is automatically agreed for a period equal to one billing cycle.
  2. On the basis of a request with an officially certified signature, which the Customer delivers to the Provider in writing, the Provider deletes the domain. The deletion of the domain does not give rise to a claim for a refund of the amount already paid (even in a pro rata part).
  3. Deleting domains according to the previous paragraph is charged according to the current price list.
